By downloading, purchasing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms supplement Apple’s applicable App Store terms and the Apple Standard Licensed Application End User License Agreement; mandatory Apple terms and non-waivable consumer protections control where applicable.
1. Eligibility
You must be at least 13 years old. If you have not reached the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian.
2. Service description and local processing
The app lets you select a video, process spoken audio, create and edit timed transcripts, translate text, edit subtitle timing and appearance, and export subtitle files or captioned videos. Features can vary by device, operating system, language, format, purchase status, region, and app version. Selected content is designed to be processed locally; we do not claim ownership of your videos or created content.
3. License and restrictions
You receive a limited, personal, revocable, nonexclusive, nontransferable, non-sublicensable license to use the app on Apple-branded devices you own or control, for lawful personal or internal business use. You may not sell, rent, copy, reverse engineer, obtain source code, create derivative works, remove notices, circumvent purchase or security controls, interfere with the Services, or use them unlawfully.
4. Your content and prohibited uses
You retain your rights in your videos, audio, transcripts, translations, subtitles, and exports. You are responsible for having all necessary rights and consents, including consent to transcribe, translate, modify, distribute, or otherwise use content. Do not violate law, privacy, publicity, intellectual-property, or contractual rights; record or distribute communications without required consent; harm others; introduce malware; or attempt unauthorized access.
5. Transcription, translation, subtitle, and export limitations
Automated transcription and translation can contain errors and may be affected by audio quality, noise, multiple speakers, accents, speech speed, terminology, names, and language selection. Translation may not preserve context, tone, humor, idioms, technical, legal, or medical meaning. Review all output before use or distribution. The app is not a certified translation service and is not a substitute for qualified professional advice where accuracy matters. Exports can differ in resolution, file size, video or audio quality, color, frame rate, metadata, compatibility, or subtitle appearance.
6. Backups and data loss
The app is not a storage or backup service. Keep independent copies of important originals and do not delete an original until you verify the completed export. Software, device, storage, permission, operating-system, or hardware errors can cause failed processing, incomplete results, corrupted files, lost edits, or data loss.
7. Free features and paid access
Features may be free, subscription-based, or available through a one-time purchase. Apple’s purchase-confirmation screen controls final price, currency, tax, trial eligibility, billing period, and renewal information. We do not store complete payment-card information.
8. Weekly subscription and trial
The weekly auto-renewing subscription is currently $4.99 per week. Payment is charged to your Apple Account when confirmed and renews weekly unless canceled through Apple Account subscription settings. Eligible new subscribers may receive a three-day free trial; Apple controls eligibility, timing, billing, and conversion to a paid subscription. Deleting the app does not cancel a subscription.
9. Lifetime purchase, restoration, cancellations, and refunds
The current $49.99 lifetime purchase is a one-time, non-renewing purchase. “Lifetime” means access to paid features while the app remains available, maintained, and capable of supporting them; it does not guarantee perpetual availability, unchanged features, future compatibility, or ongoing support. Restore Purchases applies only to eligible purchases associated with the original Apple Account. Apple handles payment and refunds under its policies and applicable law.
10. Third parties and Apple-specific terms
The Services may depend on Apple and other technologies, including the App Store, StoreKit, Photos, Files, iCloud, device media, speech, translation, sharing, and operating-system services. We do not control those services. For App Store downloads, these Terms are between you and the app provider, not Apple; Apple and its subsidiaries are intended third-party beneficiaries of the applicable license terms.
11. Intellectual property, feedback, updates, and availability
Video Translate Transcriber and its original software, design, interface, graphics, text, branding, and materials are owned by or licensed to the app provider. Feedback may be used without payment or obligation, but this does not transfer ownership of your content. We may update, modify, suspend, or discontinue the Services, subject to applicable law.
12. Disclaimers, liability, and indemnification
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness, title, noninfringement, accuracy, reliability, availability, security, or error-free operation. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Total liability will not exceed the greater of the amount paid during the preceding twelve months or $50. You agree, to the extent permitted by law, to indemnify the provider for claims arising from your content, use, rights violations, or failure to obtain required consent.
13. Governing law, changes, and contact
These Terms are governed by New York law, subject to mandatory consumer protections. If a provision is unenforceable, the remainder remains effective; failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, Apple’s applicable App Store terms, and Apple’s licensed-application agreement form the governing agreement. For questions, contact batchcompressvideos@gmail.com.
